Our primary goal at Sumday Vacations is to provide an affordable, quality timeshare and ease of ownership transfer.  Sumday Vacations will prepare all necessary documents related to the transfer and closing of the timeshare.
*All documents are recorded electronically (when applicable and available) greatly reducing the time frame for transfer.

*The closing package will be presented to the respective resort/management company for finalization and updating their ownership records recognizing a “New Owner”.

By purchasing this property, “You/Buyer(s)” consent to provide to Sumday Vacations and/or the Resort all of the following required information (within 10 days of your purchase) in order to begin the transfer process of your timeshare purchase.  NOT EVERY RESORT requires all of these items but this list is comprehensive to advise you what MAY BE required.

1. A State issued Identification (i.e. driver license)
2. Social Security Number
3. Resort Approval/Credit Application
4. A Copy of a current “Utility Bill”
5. A signed Limited Power of Attorney to the Title Company which allows Scrivener's errors to be corrected easily

 

Once you have fulfilled the above requirement, you will receive a Timeshare Purchase Agreement.  Please keep in mind, time is of the essence in all closing/transfer documents and processing, should you fail to perform any of the above requirements you open the risk of the property being relisted and sold to another party and you will not be eligible for a refund due to your inability to complete the closing process.

 

Brief Legal

Vacation Ownership Interest(s) E14618, being more particularly described as follows:

I. An undivided __/51 or 1/102 interest in and to the following:

(A) Apartment No. 111 of the Condominium Project known as "THE BAY CLUB AT WAIKOLOA BEACH RESORT" ("Condominium") established by the Declaration of Condominium Property Regime of The Bay Club at Waikoloa Beach Resort dated November 28, 1990, recorded at the Bureau of Conveyances of the State of Hawaii as Document No. 90-183537, as amended, and as shown on Condominium Map No. 1416.

Together with the following appurtenant easements:

The nonexclusive easements for ingress and egress and support of the Apartment through the common elements of the Condominium and for repair of the Apartment through all other apartments through the common elements of the Condominium.

(B) An undivided 0.4468% interest as tenant in common with other apartment owners in and to the common elements of the Condominium as described in said Declaration, as amended, subject as to the said common elements to nonexclusive easements appurtenant to all apartments for ingress, egress, support and repair.

II. The exclusive right to reserve and then use for a ONE week Use Period ( ) Every Year; ( ) Every Even Year; or (X) Every Even Year on a "Floating Time Rights" basis or for Use Period (s) N/A on a "Fixed Time Rights" basis if you have bought a permanent reservation, said Apartment or any other apartment in The Bay Club Vacation Ownership Program of the same Unit Type, as identified in that certain The Bay Club Vacation Owners Declaration of Covenants, Conditions and Restrictions, dated July 13, 1995, recorded at said Bureau as Document No. 95-091102, plus the right in common with owners of all other apartments to use and enjoy the common elements of the Condominium during said reserved Use Period.

The land upon which the Condominium Project “The Bay Club at Waikoloa Beach Resort” is located is described as follows:

All of that certain parcel of land situate at Anaehoomalu, District of South Kohala, Island and County of Hawaii, State of Hawaii, being Lot 3 of the “WAIKOLOA BEACH RESORT PHASE III”, as shown on File Plan Number 1954, filed in the Bureau of Conveyance of the State of Hawaii, containing an area of 15.0 acres, more or less.
